Casey Weaver

Casey’s international trade practice focuses on import-related compliance under the jurisdiction of US Customs and Border Protection (CBP). She advises companies with customs compliance issues, including the classification, valuation, and origin of imported merchandise, as well as the application of preferential treatment to imports under various free trade agreements. She additionally assists clients in navigating the imposition of trade and national security tariffs based on the origin or composition of the goods. She further works with clients to draft ruling requests, prepare voluntary disclosures, respond to requests for information and notices of action, and protest CBP action.

With regard to export controls and sanctions, Casey helps organizations navigate the International Traffic in Arms Regulations (ITAR), Export Administration Regulations (EAR), Foreign Corrupt Practices Act (FCPA), and National Industrial Security Program Operation Manual (NISPOM). She counsels clients regarding compliance with international trade laws and regulations administered by the Department of Commerce, Department of State, and Department of the Treasury’s Office of Foreign Asset Control (OFAC), and she works with clients to conduct internal investigations, prepare voluntary disclosures, draft and update compliance policies, and conduct compliance training.

Casey advises clients regarding the transportation of merchandise and passengers under the Jones Act, particularly involving transportation to and from the US Outer Continental Shelf. Casey advises clients on best practices for compliance and in developing and implementing compliance policies, procedures, and training tailored to the organization’s business model. Additionally, she is experienced in representing clients before various US government agencies as well as in litigation proceedings involving international trade matters.

Casey also counsels government contractors and subcontractors on various aspects of federal, state, and local procurement obligations, including compliance with the Federal Acquisition Regulations (FAR) and agency supplements to the FAR, such as the Defense Federal Acquisition Regulation Supplement (DFARS). She advises clients on contract formation and negotiation, internal investigations, and remediation related to government contracting. She also assists government contractors in navigating various domestic preference regimes to ensure compliance with sourcing obligations, including those under the Buy American Act (BAA) and Trade Agreements Act (TAA). She is experienced in executing compliance-related diligence in mergers, acquisitions, and financing transactions.

• Represented international digital security company in internal review of classification, valuation, and country of origin determinations in connection with a favorable voluntary self-disclosure submission
• Created international trade compliance policies and procedures for a variety of clients, including international digital security companies, international energy providers, and equipment manufacturers
• Obtained exclusions from Section 301 tariffs on imports of Chinese-origin goods
• Conducted due diligence, audits, and internal investigations of existing trade compliance policies and procedures for clients related to imports, exports, sanctions, and FCPA compliance
• Implemented comprehensive trade compliance programs and advised and trained clients on the implementation of those programs
• Prepared favorable voluntary disclosure submissions for a variety of clients across industries including aerospace, education and research, information technology, electronics, energy, and manufacturing
• Assisted clients of various size and in various industries apply for and obtain export licenses and approvals, including offshore oil services companies, equipment manufacturers, and research institutions
• Developed Federal Acquisition Regulation (FAR)-based business ethics and compliance programs for contractors and subcontractors, including updating and revising codes of ethics and preparing procedures for company personnel
• Conducted due diligence for defense contractors and subcontractors and counseled on potential organizational conflicts of interest and novation requirements
