AmLaw Litigation Daily gave “runners-up” honors to a Morgan Lewis team led by partner Troy Brown and including partners Su Jin Kim and Jody Barillare; associates Michael Ableson, Brian Morris, Ashley Gindle, and JC Wilt; and senior paralegal Carole Griffin for helping French food company Savencia S.A. and its US subsidiary Zausner beat back breach-of-contract and fraudulent inducement claims stemming from the 2014 sale of cheese importer and distributor Schratter Foods.
The plaintiffs, two companies formed to acquire Schratter Foods, were seeking $27.9 million in compensatory damages, which, with 10 years of prejudgment interest, could have exceeded $40 million, as well as punitive damages on their fraud-based claims. Federal jurors in Delaware sided with Savencia S.A. and Zausner and awarded $6.1 million in counterclaims related to the purchase price on the deal, a number that could approach $20 million with interest and attorney fees.
