Partner Dan Skees was quoted in a Law360 article regarding the Federal Energy Regulatory Commission’s (FERC’s) revision of its regional transmission planning policies, which requires, among other things, that transmission owners and regional transmission organizations develop plans with a 20-year outlook.
Dan told the publication that the reevaluation provisions of the new policy will be critical for compliance, since developers could be assigned projects that are eventually determined to be unneeded.
“To the extent the final rule is not prescriptive, this will be an essential, if underappreciated, focus of the compliance filings,” Dan said.
