Consumer Financial Protection Bureau – What’s Next After the CFSA Decision?

On May 16, the US Supreme Court issued a 7-2 decision upholding the constitutionality of the funding structure of the Consumer Financial Protection Bureau (CFPB). The decision clears the last remaining existential challenge for the CFPB and its enforcement, supervisory, and regulatory agenda. With the upcoming election and the CFPB announcing a substantial increase in its enforcement staff, we will likely see a dramatic uptick in the CFPB’s activity over the next eight months.
