Recent enforcement from the US Department of Justice (DOJ) and compliance guidance from the US Department of Health and Human Service’s Office of Inspector General (OIG) forecasts anti-kickback compliance as a continuing high-risk area for the medical device industry and for related healthcare professional and institutional stakeholders.
The recent federal amendments to the Anti-Kickback Statute (AKS) provide opportunities, while at the same time, there is an uptick in AKS enforcement. AdvaMed’s 2022 update to its pioneering Code of Ethics provides device companies, healthcare professionals, and other stakeholders a practical navigation tool as arrangements begin to reflect the virtual care delivery and value-based care models recognized in the anti-kickback amendments.
