With a dual focus on litigation and regulatory compliance, Tesch Leigh West represents providers in federal and state government investigations and litigation matters relating to criminal, civil, and administrative allegations, including violations of federal healthcare program fraud and abuse laws. Tesch provides regulatory guidance to a variety of entities including states, hospitals, clinics, pharmacies, durable medical equipment (DME) suppliers and wholesalers, independent diagnostic testing facilities (IDTFs), health plans, and associations. Such guidance relates to state regulatory matters as well as Medicare and Medicaid reimbursement and coding, value-based care arrangements, risk adjustment, supplemental payments and financing options, and analysis related to Medicaid state plans and Section 1115 demonstration waivers.
Tesch provides litigation support and compliance guidance with respect to state and federal healthcare program fraud and abuse laws and telehealth laws. She has experience with the False Claims Act and the Anti-Kickback Statute, having aided in investigations and disputes involving data-driven healthcare companies, charitable organizations, pharmacies, healthcare management consulting firms, medical groups, as well as certifying actuaries for Medicare Advantage bids. Tesch has experience investigating and addressing qui tam complaints and responding to governmental subpoenas and document requests.
Tesch also helps clients navigate a variety of federal and state regulatory issues, including licensure and scope of practice; pharmacy establishment, reporting, and compliance; telehealth and telemedicine; and Medicare and Medicaid enrollment, compliance, and reimbursement. Tesch has led numerous multistate and 50-state surveys on subjects such as scope of practice, supervision and delegation, change of ownership and change of information, advertising and marketing professional corporation requirements and corporate practice of medicine, asynchronous telehealth, nonemergency medical transportation, and laboratory billing.
Tesch assists with compliance reviews for health plan risk adjustment programs, reviewing contract agreements between managed care organizations (MCOs) and downstream entities, and analyzing Medicare Part D and Part C bid issues. She also assesses healthcare compliance programs in connection with periodic compliance program reviews and investor due diligence.
Before joining Morgan Lewis, Tesch was a healthcare associate at a global law firm where she focused on fraud, abuse, and managed care regulatory compliance. Tesch was also a legal intern at the Federal Communications Commission’s Connect2Health Taskforce, as well as a summer associate at a boutique law firm in Virginia specializing in long-term care hospital (LTCH) reimbursement.
Tesch is a graduate from the George Washington University Law School where she was a member of the moot court board, the alternative dispute resolution board, and the George Washington Journal of Energy & Environmental Law.
