Insurance Recovery Litigation

• Lead counsel to a transportation company in a lawsuit brought in Massachusetts state court against the company’s insurance carrier seeking coverage for liabilities arising out of a serious bus accident. Jeffrey recovered in excess of $3 million in defense costs and affiliated damages for his client.
• Represents several affiliated valve and flow control manufacturing companies in insurance coverage litigation brought in the state courts in California, Massachusetts, New York, and Illinois involving claims for insurance coverage for thousands of asbestos and silica liabilities. Jeffrey has negotiated insurance settlements totaling more than $500 million for his clients in connection with this multistate litigation.
• Co-lead trial counsel to a chemical manufacturer seeking damages from its insurer arising out of the insurer’s breaches of its duty to defend and indemnify the company for product liability and premises liability suits asserted against the compan­­­y. After a five-week trial in Massachusetts state court, a jury returned a verdict in favor­ of his client, including a finding that the insurer had engaged in bad faith. Jeffrey’s client was awarded its actual damages as well as bad-faith damages and attorneys’ fees.
• Lead counsel for a major retailer in the defense of a putative class action brought in the US District Court for the District of New Hampshire relating to broad-based, leveraged, corporate-owned life insurance policies. After a successful motion to dismiss ruling, Jeffrey negotiated a favorable settlement for his client.
• Lead counsel to a transportation company in the defense of a lawsuit asserted by its insurer in the US District Court for the District of Massachusetts seeking payment of retrospective premiums under primary general liability policies. Following an aggressive discovery strategy, Jeffrey negotiated a successful settlement for his client.
• Representation of an investment bank in an insurance coverage action filed in the State of Maryland seeking coverage under professional services policies for various suits asserted against the bank resulting from brokerage and investment management activities.

Commercial Contract/Business Fraud Litigation

• Lead counsel for a vehicle emissions inspection services company in the defense of a multicount breach of contract action brought in the US District Court for the District of Connecticut. Jeffrey obtained a complete dismissal of the action on a motion to dismiss.
• Co-lead counsel for a major medical device manufacturer in the defense of a breach-of-contract action in Massachusetts state court seeking lost profits and royalty damages. Following an aggressive defense strategy, a favorable settlement was achieved for this client.
• Representation of an asset management company in the defense of a securities action brought in state court in Rhode Island involving alleged mismanagement of investment accounts.
• Representation of a finance company in the prosecution of a fraud and RICO action.
