Several Morgan Lewis lawyers will speak at the American Bar Association’s (ABA’s) 2024 Insurance Coverage Litigation Committee CLE Seminar.
Partner Brad Nes will moderate the breakout session Alternative Procedural Paths for Coverage Litigation, which will address modern litigation scenarios that may call for procedural alternatives to the standard policyholder and insurer playbooks. The scenarios and alternatives will be considered from the perspective of policyholder interests, insurer interests, and judiciary preferences.
Partner Jay Konkel will participate in the roundtable Whose Liability Is It Anyway? The program will review a scenario in which a co-insurer or co-defendant announces that it is insolvent, and then analyze the circumstances under which an insolvent’s predecessors, successors, or other relevant parties can be brought to the table.
Associate Robert Jacques will speak on the roundtable The State vs. The Insurance Industry: A Discussion of Responsibilities for Catastrophic Losses, which will address the dynamics between public and private responsibility for catastrophes in the United States, including implications for insurance coverage, with an emphasis on cyber and potential private-public frameworks to address cyber risks.
