Michael W. Fakhoury

Michael W. Fakhoury represents clients in the areas of complex civil litigation, antitrust and securities litigation, global trademark and copyright litigation, and class action defense. In addition to high-stakes litigation, Michael also represents clients in government investigations and enforcement actions before the FTC, DOJ, SEC, state attorneys general, and other regulatory authorities. He has experience representing companies in the technology, healthcare, automotive, ecommerce, consumer products, manufacturing, and retail sectors. In both defense and enforcement matters, Michael approaches clients’ disputes strategically and with a goal of resolving them expeditiously.

Prior to joining Morgan Lewis, Michael was a law clerk to Judge Victoria A. Roberts of the US District Court for the Eastern District of Michigan. While in law school, Michael worked at the SEC’s Office of the General Counsel and Meta Platforms Inc. He also served as the editor-in-chief of the Georgetown Immigration Law Journal.

  • Defended broker-dealer in a litigation of first impression brought by the SEC challenging compliance with a new rule; obtained highly favorable settlement
  • Represented public company in high-stakes copyright and trade secret matter; resolved matter pre-suit
  • Defended higher education corporation and public corporation in FTC Bureau of Consumer Protection investigations of marketing and advertising practices; obtained highly favorable resolutions
  • Defended technology company in products liability litigation; obtained complete dismissal on motion to dismiss
  • Represented retail and specialty pharmacies and healthcare companies in a range of state and federal regulatory matters, including Medicare and Medicaid reimbursement matters and internal investigations
  • Defended public technology company in class action filed under the Illinois Biometric Information Privacy Act; obtained complete dismissal on summary judgment
