Morgan Lewis partners Lance Dial, Erin Martin, and Kirstin Gibbs drafted an article for Reuters describing key provisions of the US Securities and Exchange Commission’s (SEC’s) proposed climate disclosure rules related to asset management. According to the article, asset managers have been clamoring for issuers to provide increased information disclosures on their exposure to and resiliency against climate-change risks. This resulted in several new initiatives, such as the Task Force on Climate-Related Disclosures, the Net Zero Asset Managers Initiative, and the Climate Action 100+. But up until its recent proposal, the SEC had not set forth any mandatory rules regarding disclosures, creating inconsistency and confusion across issuers.
