Partner Ron Dreben commented for a World Trademark Review article on the recent report from the US Copyright Office providing guidance and recommendations on copyright and artificial intelligence (AI). The article notes that among the report’s recommendations is the suggestion that generative AI prompts, no matter how detailed, should not be considered human authorship for the purposes of copyright protection. Ron offered an alternative and hopeful take.
“Overall the office’s report is persuasive of its positions. But I, like others, still cling to the belief (or hope) that some prompts could be viewed as an electronic brush controlled by text or voice command, exercising sufficient human control of the output,” Ron shared.
