Superfund Reviews for Two PFAS Among Policies EPA Developing, Bloomberg Law

Bloomberg Law quoted partner John McGahren in an article about the Environmental Protection Agency’s (EPA’s) recent designation of perfluorooctanoic acid (PFOA) and perfluorooctane sulfonic acid (PFOS) as hazardous substances under the Comprehensive Environmental Response, Compensation, and Liability Act. The article also examines the resulting delays in Superfund-site cleanup decisions, the agency’s evolving policies, and the challenges posed by limited waste management capacity for per- and polyfluoroalkyl substances (PFAS).

Speaking on a panel at the Air & Waste Management Association’s November meeting, John emphasized that the EPA’s new rule designating PFOA and PFOS as hazardous substances is delaying cleanup decisions at Superfund sites, including whether “a landfill should be capped.” He also highlighted the challenges for companies managing PFAS waste, noting the “limited number of waste management facilities that can handle PFAS” and the need for careful planning.
