Partner Amy Magnano spoke with TechTarget about enforcement of and compliance with an information-blocking rule from the US Department of Health and Human Services (HHS) and Centers for Medicare & Medicaid Services (CMS). Amy said healthcare providers and their counsel should brush up on the requirements of the rule, including state requirements, and know which scenarios do not constitute information blocking.
“Most states have very specific requirements on how and when you can release certain types of healthcare information,” Amy said. “Being familiar with those state requirements and understanding that that won’t necessarily be information blocking is a good thing for healthcare providers to familiarize themselves with.”
