We’re All Labor Lawyers Now: Decoding the Final Prevailing Wage Regs, Tax Notes

Partner Casey August spoke with Tax Notes for an article about the final prevailing wage and apprenticeship rules promulgated by the Department of the Treasury and IRS as part of the energy tax provisions of the Inflation Reduction Act.

Casey observed that the rules’ preamble states that they were designed in consultation with the Labor Department regarding best practices.

“The final regulations focus on having compliance controls and remediation procedures that are regularly reviewed, as well as on worker notification and whistleblower concerns,” Casey said.

He added that final rules could mean that the multiple pages of covenants on prevailing wages and apprenticeships in engineering, procurement, and construction contracts could grow because of taxpayers wanting additional due diligence to be done and practices followed.
