Partner John Ring is quoted in an HR Magazine article discussing the National Labor Relations Board’s (NLRB’s) blocking charge change, which reverses a 2020 rule requiring NLRB regional directors to hold elections amid allegations of unfair labor practices. John said that with the change, if employees become dissatisfied with their union and decide to decertify, a union need only file an unfair labor practice, which blocks the decertification process from moving forward.
“Then, the NLRB takes a year or more to investigate the charge, during which employees remain stuck with a union,” John said. “Over the years, there were tremendous blocking charge abuses, which the 2020 rule was designed to stop. The NLRB has returned to the old procedures that make it very difficult for employees to decertify a union.”
