Partner Giovanna Cinelli is featured in a The National Law Journal article about expectations that the Biden administration will establish a screening mechanism to review U.S. companies’ outbound investments in certain sectors and countries for national security risks.
“Now, everyone has the idea that we have to control capital flows so that when we cut off technology, we don’t end up still helping competitors or adversaries develop capabilities that can be used against U.S. interests,” Giovanna said.
“We’re restricting technology [from] going to different countries. That’s what our export laws do. But there’s no mechanism that prevents companies from suddenly sharing cash to establish facilities overseas.”
