Partner Kirstin Gibbs spoke with Law360 about how the Federal Energy Regulatory Commission’s (FERC’s) plans to evaluate natural gas projects based on greenhouse gas emissions may be affected by a recent court decision. A federal judge issued a preliminary injunction blocking the Biden-Harris administration’s attempt to increase estimated social cost of carbon (SCC), which FERC could use to evaluate certain projects. "I think FERC has a lot of runway to address the question of how, when or why to use the social cost of carbon on gas infrastructure," Kirstin said. "It's an interesting data point, but I'm not sure this is going to cause a lot of late-night backroom decisions."
