Michelle Park Chiu

Recognized in Bloomberg Law’s inaugural “They’ve Got Next: The 40 Under 40” in 2021 and as a Rising Star by the Minority Corporate Counsel Association in 2024, Michelle regularly defends global technology companies in antitrust litigation in the Northern District of California. She played a key role at trial for a global technology company in a federal antitrust jury trial, and second-chaired a bench trial on behalf of one of California’s largest health plans. She currently defends an international technology company against price-fixing claims in multiple markets for electronic components. She defended a mortgage technology company in litigation brought by the US Federal Trade Commission (FTC) challenging a proposed $16 billion acquisition.

Michelle also represents clients in complex commercial disputes. As lead counsel, she successfully obtained a $24 million judgment on behalf of a financial institution pursuant to an indemnification agreement relating to a data breach in the Southern District of Texas, which was affirmed by the Fifth Circuit. Additionally, she has successfully enforced arbitration clauses on behalf of financial institutions in multiple putative class action claims in state and federal courts.

Michelle has an active pro bono practice. She successfully defended a detained refugee in removal proceedings, resulting in the complete dismissal of all charges against the client during a multiyear representation that resulted in the client becoming a naturalized US citizen. Michelle currently serves on the Morgan Lewis Foundation Board.

• Represented a global technology company in multidistrict litigation alleging monopolization claims relating to the mobile application market for mobile devices
• Represented a mortgage technology company in defending litigation brought by the FTC challenging a proposed $16 billion acquisition
• Represented international technology companies in multidistrict litigation alleging price-fixing claims relating to the HDD suspension assemblies, capacitors, and inductors markets
• Represented a health insurance company facing vertical restraint claims pursuant to the Cartwright Act where she served as second-chair trial counsel
• Represented multiple international technology companies in multidistrict antitrust litigation concerning the CRT and LCD markets involving class action and direct action plaintiffs in the Northern District of California

Complex Commercial Litigation Matters

• Represented a financial institution in a breach of contract claim of more than $24 million arising out of an indemnification agreement relating to a data breach
• Represented a financial institution in putative class actions alleging violations of the California Unruh Act, Federal Equal Credit Opportunity Act, and California Bus. & Prof. Code § 17200; resulted in successful enforcement of consumer arbitration agreements as well as a favorable outcome on appeal before the Ninth Circuit
• Represented in arbitration a technology company in mass arbitration disputes involving complex breach of contract claims
• Represented a consumer products manufacturer in a class action defense in the Northern District of California alleging false advertising and unfair competition claims under California state law based on statements the product is “all natural”
• Represented a financial institution in a UCL action brought by the California State Attorney General resulting in favorable settlement
