Partner David Plotinsky spoke with MLex about the apparent politicization of the Committee on Foreign Investment in the United States (CFIUS), as seen in its inability to reach a consensus on the proposed Nippon Steel-US Steel merger. David noted that the politicization of CFIUS is “undermining the industry’s trust in CFIUS, both foreign and in the U.S.”
“We are seeing collateral effects in investor skittishness. I don’t think it is too late to save this so long as the White House doesn’t block it. People will see it as a unicorn, and it won’t tarnish CFIUS’s reputation. If it ends in a block, it will do lasting damage,” David said.
