Industry Sees PFAS Reporting Rule Delay as Sign Of Eased TSCA Mandates, Inside TCSA

A Morgan Lewis LawFlash by partners Jeremy Esterkin, Stephanie Feingold, and associate Sarah Carter is cited by Inside TSCA in an article about the US Environmental Protection Agency’s (EPA’s) decision to push back regulations governing per- and polyfluoroalkyl substances (PFAS) reporting. The regulations were set for final publishing in January 2023 but have been delayed to at least March.

“The final rule may not . . . dramatically narrow the proposed rule overall, but the delay in issuing the final rule does suggest that EPA is seriously considering measures to mitigate the considerable estimated impacts on small entities at a minimum, and possibly on manufacturers and article importers of any size,” wrote Inside TCSA, quoting the LawFlash.
