The Insight details recent attempts by US legislators to establish an all-encompassing federal data privacy law as well as efforts by the US Federal Communications Commission (FCC) and US Federal Trade Commission (FTC) to address and enforce current data privacy laws and potentially propose new rules in connection with commercial surveillance and data security.
It further details recent developments in the application of the Computer Fraud and Abuse Act (CFAA) and walks through privacy-related legislation recently introduced in Congress, including the American Data Privacy and Protection Act, the Data Privacy Act of 2023, and the Upholding Protections for Health and Online Location Data Privacy Act (UPHOLD).
