Yongo Ding advises banks and other financial services firms on ERISA fiduciary and prohibited transaction issues associated with the investment of employee benefit plan assets, including through stable value funds and collective investment trusts (CITs). He also regularly advises employers on the design, operation, and compliance of tax-qualified retirement plans, nonqualified deferred compensation plans, and incentive and equity arrangements.
A substantial portion of Yongo’s practice is devoted to helping retirement plan sponsors navigate the tax and ERISA requirements applicable to 401(k) and defined benefit plans, including fiduciary issues associated with various types of investment vehicles and pension de-risking activities. He also advises sponsors on remedial correction programs for both qualified retirement plans and nonqualified deferred compensation plans subject to section 409A of the Internal Revenue Code.
