Eric Makinen represents employers in a wide range of labor and employment disputes, including wage and hour class/collective litigation and other complex litigation matters. In addition to misclassification, unpaid overtime, minimum wage, and other wage and hour claims, Eric litigates harassment, discrimination, and Employee Retirement Income Security Act (ERISA) claims and restrictive covenant disputes on behalf of clients in the retail, manufacturing, financial services, insurance, and technology industries.
In addition to his litigation practice, clients consult Eric with respect to managing and responding to crises that pose both reputational and economic risks. As part of this preventative practice, Eric advises clients on executive compensation disputes, bonus and commission plans, employment classification decisions, labor relations, employment policy issues, and arbitration policies, among other systemic employment-related business issues.
Eric also maintains an active international labor and employment practice, advising clients on supply chain and forced labor risks as well as defending clients against claims before the Organization for Economic Cooperation and Development (OECD).
