Sydney Reed Swanson focuses her practice on healthcare regulatory and privacy law in compliance, litigation, and transactional matters. Sydney helps clients to understand the regulatory requirements unique to their provider type and business model. Sydney represents clients in fielding False Claims Act investigations and litigation, overpayment disputes, and enforcement proceedings. Sydney is a member of the firm’s global privacy and cybersecurity practice and counsels clients on compliance with HIPAA and state privacy laws. She defends clients in government investigations related to data security incidents.
Sydney has experience advising physician, optometry, and dental practices, hospitals, dialysis facilities, hospices, home health agencies, long-term care facilities, nursing homes, pharmacies, independent diagnostic testing facilities (IDTFs), and durable medical equipment suppliers and wholesalers on healthcare regulatory matters. Sydney also works closely with providers, insurers, and information technology companies alike on navigating healthcare privacy matters.
Sydney’s work spans a variety of matters related to Medicare and Medicaid billing compliance and fraud and abuse laws, such as the Stark Law, the Anti-Kickback Statute, and the Civil Monetary Penalties Law. She also represents clients in healthcare matters before state and federal agencies and through administrative appeals, including claims appeals of recovery audit contractors, integrity contractors, and other Medicare and Medicaid contractors and payors.
Sydney has experience representing private equity and financial investor clients on mergers and acquisitions, including performing healthcare regulatory and healthcare privacy due diligence and advising on change of ownership issues.
Sydney has spearheaded various multistate and 50-state surveys on subjects such as prescription delivery and signature requirements for pharmacies, scope of practice, supervision and delegation, licensure, enrollment and change of ownership, reimbursement, advertising and marketing, corporate practice of medicine, telehealth, breach notification requirements, and management and disclosure of protected health information and other sensitive information.
Sydney provides compliance support related to state-specific healthcare regulatory issues for pharmacies, such as Medicaid enrollment requirements for out-of-state pharmacies, pharmacy licensure requirements, and use of emerging technologies by pharmacies.
During law school, Sydney served as the editor-in-chief of the Houston Journal of Health Law & Policy and competed as a member of the University of Houston Law Center's moot court team.
