Jonathan P. York represents corporate clients across the United States in government and internal investigations and complex litigation, regularly counseling and defending companies against civil and criminal matters before enforcement agencies such as the US Department of Justice. He handles a range of complex fraud, abuse, and compliance matters involving the False Claims Act (FCA) and Anti-Kickback Statute for an array of healthcare and life sciences industry clients, including global pharmaceutical and medical device manufacturers, postacute care providers, pharmacies, and digital health companies.
Jonathan calls upon this experience to advise clients on the design, implementation, and assessment of mandatory and voluntary compliance and integrity programs for healthcare entities and life sciences companies.
Jonathan routinely counsels clients on all aspects of the investigation and enforcement process and uses his breadth of experience to strategically respond for and advocate on behalf of clients to government counsel. In addition, Jonathan maintains an active litigation practice, leveraging his knowledge and experience with the FCA to regularly defend clients against qui tam complaints in federal court. He also has experience in criminal litigation arising from allegations of fraud and corruption.
As part of his pro bono practice, Jonathan regularly guides clients pursuing civil litigation in federal and state court. Jonathan has helped pro bono clients secure favorable outcomes in civil litigation, including a recent settlement with the United States on behalf of a father and son separated at the US/Mexico border through an action brought under the Federal Tort Claims Act (FTCA).
Prior to rejoining Morgan Lewis in 2020, Jonathan clerked on the US District Court for the Western District of Kentucky for Senior Judge Charles R. Simson III. In law school, Jonathan served as a law clerk for the University of Pennsylvania and University of Pennsylvania Health System Office of General Counsel where he focused on healthcare compliance matters. He was also a member of the senior editorial board for the Virginia Journal of Social Policy and the Law.
