Dana Gross maintains a broad practice that focuses on the protection and licensing of intellectual property rights, with an emphasis on global brand management; complex corporate transactions; name, image, and likeness (NIL) rights; sponsorships and endorsements; copyrights; and domain name and internet enforcement matters. Dana routinely advises clients in a wide range of industries, including retail and ecommerce, sports, financial services, software, chemicals, life sciences, and travel and leisure.
Dana works with clients to implement brand protection strategies and manages US and international trademark portfolios across different industries. In this capacity, he helps clients clear, register, and enforce trademarks worldwide.
Dana also handles the IP aspects of a broad range of complex commercial transactions, including mergers and acquisitions and financings, coordinating IP diligence, developing and implementing plans to mitigate those risks identified during the diligence process, and drafting and negotiating all related agreements.
In addition, Dana works on a wide range of IP licenses and services agreements, with a focus on sponsorship and endorsement arrangements. Notably, Dana has advised some of the world’s largest brands in connection with sponsorship relationships, has handled sponsorship agreements for or with several professional sports leagues and their individual teams, and has advised a four-time PGA champion in connection with his personal endorsement deals. Dana also maintains an active NIL practice, advising clients on issues related to student athletes and the monetization of their NIL rights, and representing a national sports federation in connection with the negotiation of the NIL aspects of its collective bargaining agreement with its players.
Dana has broad experience involving the protection of IP on the internet, and routinely counsels clients on issues pertaining to domain name portfolio management, ICANN’s new generic Top-Level Domain (gTLD) program, and online enforcement matters, including Uniform Domain Name Dispute Resolution Policy (UDRP) complaints and the takedown procedures of the Digital Millennium Copyright Act (DMCA).
Dana also advises clients on copyright issues, including the application of the fair use defense and the statutory right of termination, and assists clients with copyright filing programs and the implementation of copyright compliance programs.
Dana is active in the International Trademark Association (INTA), has hosted an INTA roundtable on ICANN’s New gTLD Program, and is a three-term member of INTA’s Internet Committee.
Prior to law school, Dana worked for a US senator in various capacities. He joined Morgan Lewis after working at another international law firm, where he practiced in the corporate finance and intellectual property groups.
