Michael C. D’Agostino is an experienced litigator and trial lawyer who handles a wide range of complex matters in both state and federal courts across the United States and abroad. In his practice, Michael assists clients in responding to governmental investigations and subpoenas, and insurance and reinsurance related disputes. He also has a deep understanding of the role insurance and reinsurance brokers play in helping their clients secure and maintain coverage and resolving disputes that arise in that arena. Michael also advises Connecticut-based employers on Connecticut employment law matters and appears on their behalf at the Connecticut Commission on Human Rights and Opportunities.

Michael has advised Connecticut-based employers on the state’s COVID-19 protocols and reopening guidelines. He has tracked workers’ compensation–related developments during the COVID-19 pandemic and has advised on executive orders, legislation, and state laws that impact the analysis of workers’ compensation for COVID-19.

After a week-long jury trial in the Philadelphia Court of Common Pleas, obtained a directed verdict in a tortious interference case for Guy Carpenter & Company.
Representing Marsh & McLennan Companies, Inc, in a unique case brought under the Defend Trade Secrets Act in the Southern District of New York that resulted in a favorable settlement prior to trial.
Defending more than two-dozen former shareholders of the Tribune Company in a fraudulent-transfer action brought by the Tribune Litigation Trustee, in which the Trustee seeks to claw-back hundreds of millions of dollars paid to the shareholders as part of Tribune’s leveraged buy-out.
Representing a reinsurance broker in an antitrust investigation and lawsuit filed by the Connecticut Attorney General, which resulted in a favorable settlement.
Helping life insurance companies cedents challenge and arbitrate rate increases sought by reinsurers on yearly renewable term programs.
Successfully negotiating with the Connecticut Attorney General’s office and officials in other states to effect the orderly wind-down of a national broadcasting school.
Responding to an investigation by the Connecticut Attorney General of hotel pricing, resulting in no action against the firm’s clients.
Coordinating litigation in the London office on behalf of a group of bondholders in the TXU (Europe) restructuring.
