Lisa C. Dykstra is an experienced litigator and trial attorney who represents pharmaceutical manufacturers, medical device companies, healthcare providers, and government contractors. Her practice focuses on internal and government investigations, criminal proceedings, complex and parallel civil litigation, regulatory enforcement proceedings, and government contracting disputes. As a key member of the firm’s crisis management team, Lisa plays a vital role in developing and executing strategies to manage and resolve large-scale, high-profile crisis situations. Lisa’s matters involve cases arising under the False Claims Act (FCA); the Federal Food, Drug, and Cosmetic Act (FDCA); the Anti-Kickback Statute (AKA); the Foreign Corrupt Practices Act (FCPA); Antitrust laws; and the Medicaid Rebate Statute.
Lisa also provides guidance on complex compliance issues, oversees compliance audits, and has negotiated and monitored compliance agreements with the US Department of Health and Human Services Office of Inspector General (HHS-OIG) and state attorneys general.
In addition, Lisa serves as national discovery counsel to a major pharmaceutical client, managing and counseling on complex discovery strategies across its portfolio of litigation and investigations. In this role, Lisa manages strategy across product liability matters, government investigations, civil litigation, and patent litigation to ensure consistent advocacy and positions.
Lisa served as an assistant US attorney in the District of New Jersey Criminal Division.
Lisa has an active pro bono practice. She has served on the Criminal Justice Act Panel for the US District Court for the Eastern District of Pennsylvania, and is a participant in the Pennsylvania Innocence Project. In addition, Lisa co-chairs the Vetri Community Partnership’s board of directors, and serves on the USC Shoah Foundation’s leadership council and The Wistar Institute’s leadership council.
Lisa regularly lectures on FCA litigation, compliance issues, white collar crime, ethics, and internal investigations. She frequently participates in seminars and advises in-house counsel on managing internal investigations, creating and implementing compliance programs, and decision-making around indemnifying employees. Lisa is also a frequent panelist at educational events.
