After many months of waiting, the US Department of Labor (DOL) has issued a final regulation revising earlier guidance on whether and how ERISA plan fiduciaries may consider environmental, social, and governance (ESG) factors in investment decision making and proxy voting.
The ruling arrives at a time of increasing interest in and scrutiny of the use of ESG in ERISA plan fiduciaries and follows more than 25 years of back-and-forth from the DOL on whether and how ERISA plan fiduciaries can apply ESG in accordance with their fiduciary duties.
