Partner David Plotinsky spoke with the Financial Times about the lawsuit brought by US Steel and Nippon Steel against the federal government in the wake of President Biden’s order to block Nippon Steel’s planned acquisition of US Steel.
David told the publication that the litigation challenge to the Committee on Foreign Investment in the US process would be an “uphill battle” due to the expansive scope of what can constitute national security. However, he added that “the government is faced with some genuinely bad facts in this case.”
