Michael Luskin represents financial institutions in commercial litigation in state, federal, and bankruptcy courts. He focuses his practice on enforcing creditors’ rights under complex credit agreements both in and out of court and defending creditors against “lender liability,” recharacterization, fraudulent conveyance and preference claims, and other claims in bankruptcies brought by creditors’ committees and bankruptcy trustees. Michael also represents creditors in loan restructurings and out-of-court workouts and trustees and examiners in complex litigation cases.
Throughout his career, Michael has counseled lenders, financial institutions, and other companies involved in complex cases, including Chapter 11 proceedings, real estate restructurings, foreclosures, and other litigation. Michael’s client representations span an array of industries, including real estate, energy, insurance, hospitality, healthcare, pharmaceuticals, airlines, and automotive. Chambers USA noted that Michael’s clients say, “It’s very rare to find a litigator who can litigate and negotiate but he can do both very well.”
Michael is a fellow of the American College of Bankruptcy and frequently speaks about bankruptcy litigation issues and bankruptcy law developments. Prior to joining Morgan Lewis, Michael served as senior counsel in the New York office of a national law firm.
