The US Department of Labor’s (DOL’s) long-awaited Final Rule regarding independent contractor classification under the Fair Labor Standards Act (FLSA) was published on January 10. Depending on the facts and type of work at issue, the Final Rule may expand FLSA coverage to additional workers who are currently classified as independent contractors.

The Final Rule takes effect on March 11. In the meantime, companies should evaluate their existing contractor engagements and take steps to solidify those engagements in light of the evolving independent contractor landscape.
